1. ACCEPTANCE OF TERMS

Welcome to Foom ("For Only One Me"), a privacy-native AI browser platform functioning as your Personal Edge Twin ("PET"), provided by Foom LLC ("Foom," "we," "us," or "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Foom LLC. By downloading, installing, accessing, signing in to, or otherwise using the Foom application, including downloading software directly from heyfoom.com, or using any related services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App or Services.

2. ELIGIBILITY, AGE VERIFICATION, AND CAPACITY

The App and Services are intended solely for adult users who are at least eighteen (18) years old. During registration, Foom collects date of birth to verify that you satisfy this age requirement. Foom may request additional age verification if necessary to confirm eligibility or comply with law. By accessing or using the Services, you represent and warrant that you are 18 years of age or older and have the legal right, capacity, and authority to enter into these Terms. Foom may suspend or terminate access for any user who fails to meet this eligibility requirement or fails to provide requested verification.

3. GEOGRAPHIC RESTRICTIONS

The Services are currently authorized for use only by individuals located within the United States of America or the Republic of India. By using the Services, you represent and warrant that you are physically located within one of these permitted jurisdictions. To enforce this geographic restriction and comply with applicable export and regulatory laws, the App accesses and processes your device geolocation and/or IP-derived location before and during your use of the Services. If Foom cannot verify that you are located in a permitted region, you may be unable to create an account or use the Services.

4. DESCRIPTION OF SERVICES

Foom provides a software platform designed to create and run AI agents on your device while operating as a privacy-centric web browser. The App supports artificial intelligence inference using open-source language models, may permit on-device model training using user-provided data, and may offer optional or configurable cloud-based integrations to enhance functionality.

5. DATA PROCESSING, PRIVACY, AND THIRD-PARTY INTEGRATIONS

Foom is designed with a privacy-first operational model. Data processing depends on the feature used and your configuration choices:

  • Local on-device processing: For local workflows, user inputs, files, outputs, and local model training data are processed on your device and are not transmitted to or stored on Foom servers.
  • Non-Google cloud AI integrations: Foom may use cloud AI APIs from external providers, including Google, OpenAI, Perplexity, and Anthropic. Some cloud integrations may be enabled by default for non-Google workflows, and you may change available settings in the App. When a non-Google cloud AI workflow is active, the prompts, files, or other content that you submit to that non-Google workflow may be transmitted to the selected provider for processing. Your use of a cloud workflow constitutes your consent to that processing.
  • Google API scopes and use: If you authorize Foom to access your Google account, Google Drive, or Google Workspace account, Foom requests only the scopes needed for the user-facing feature. For Drive, Foom requests https://www.googleapis.com/auth/drive.readonly. This scope can permit viewing and downloading Drive files, but Foom uses it only to access files you select or expressly request Foom to analyze in the App.
  • Google API Data firewall: Information received from Google APIs, including Google Sign-In profile data, Google Drive file content, Google Drive file metadata, OAuth tokens, and information derived from those items ("Google API Data"), is not transmitted, disclosed, or otherwise made available to OpenAI, Anthropic, Perplexity, or any other non-Google third-party AI provider. Non-Google cloud AI integrations are separate from Google API workflows, and Foom excludes Google API Data from prompts, context, files, or requests sent to non-Google AI providers.
  • Google Limited Use commitments: Foom's use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements. Foom does not sell Google API Data, use Google API Data for advertising, use Google API Data to train or improve generalized AI or ML models, or allow humans to read Google API Data except with your explicit consent for support involving specific data, for security or abuse investigation, to comply with law, or for aggregated and anonymized internal operations.
  • Google Data retention: Foom does not store Google Drive file contents on Foom servers. Local cached copies may remain on your device and can be deleted by you. OAuth tokens, if stored, are encrypted at rest and used only to maintain your authorized Google connection. You may revoke access through the App or through your Google account settings.
  • Telemetry: Foom may collect limited anonymous or aggregated telemetry, such as crash and error metrics, performance metrics, usage frequency, time spent in the App, and feature interactions, to monitor stability, debug, improve the App, and support aggregate internal operations. Telemetry does not include the substantive content of your prompts, documents, local files, browsing content, or Google Drive files.

6. LICENSE GRANT, PROPRIETARY RIGHTS, AND OPEN-SOURCE EXCEPTIONS

  • Proprietary license: Subject to your compliance with these Terms, and excluding open-source components incorporated into the App, Foom grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App solely for your personal, consumer purposes. The App is not licensed for enterprise or commercial redistribution. You may not modify, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of Foom proprietary features except to the extent such restrictions are prohibited by law.
  • Open-source components: The App may use open-source frameworks, engines, libraries, or models, including Chromium/Blink, WebKit, llama.cpp, ONNX Runtime, or similar components. Nothing in these Terms restricts rights you may have under the applicable upstream open-source licenses.

7. ACCEPTABLE USE AND CONTENT SAFEGUARDS

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Services for fraudulent, malicious, illegal, or harmful activity, or to promote such activity.
  • Attempt to bypass, break, manipulate, or exploit safety filters or safeguards, including filters designed to restrict NSFW, sexually explicit, or otherwise prohibited content.
  • Input content or direct the AI to generate output that misappropriates or infringes the copyright, trademark, patent, trade secret, privacy, publicity, or other rights of any third party.
  • Input personally identifiable information of third parties without appropriate legal authority or consent, or use the App to process data in violation of applicable privacy laws.
  • Use the Services to interfere with, disrupt, or compromise the App, Foom systems, third-party services, or other users.

8. PLANS, FEES, AND PAYMENT

Foom may operate on a tiered subscription model distributed through our website. For current pricing details, please visit heyfoom.com/pricing. If you purchase a paid subscription through heyfoom.com, billing and payments are administered through our authorized payment processor, Stripe. Your subscription will automatically renew unless canceled at least twenty-four (24) hours before the end of the current billing period.

Your account may be charged for renewal within 24 hours before the end of the current period. Subscriptions may be managed or canceled by contacting support or using your account billing settings on heyfoom.com.

9. THIRD-PARTY WEB CONTENT AND TRACKING DISCLAIMER

As a web browser, Foom facilitates access to the open internet.

  • Content liability: Foom does not control, endorse, monitor, or assume liability for third-party websites, content, services, or materials accessed through the App. Foom disclaims liability for damages, malware, data loss, or offensive material encountered during internet navigation.
  • Independent web tracking: Third-party websites or applications accessed through the open web may use cookies, pixels, and other tracking technologies. Such tracking is performed independently by third parties, without participation by Foom. You are responsible for protecting your privacy and data when navigating the open web.

10. DISCLAIMERS OF WARRANTY AND LIMITATION OF LIABILITY

THE APP AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOM DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOU ACKNOWLEDGE THAT ARTIFICIAL INTELLIGENCE IS AN EVOLVING TECHNOLOGY AND THAT OUTPUTS MAY BE INACCURATE, UNPREDICTABLE, OR INAPPROPRIATE. FOOM DOES NOT WARRANT THAT ANY OUTPUT IS FACTUALLY CORRECT OR SUITABLE FOR PROFESSIONAL, LEGAL, MEDICAL, FINANCIAL, OR OTHER RELIANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOOM, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICES. FOOM'S AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT PAID BY YOU TO FOOM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

Some jurisdictions do not allow certain warranty disclaimers or liability limitations. In those jurisdictions, Foom's liability will be limited to the greatest extent permitted by law.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any disputes arising out of or related to them are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, including their interpretation, validity, breach, termination, or enforcement, shall be determined by binding arbitration. You waive your right to a trial by jury or to participate in a class action proceeding to the extent permitted by law.

You may opt out of this arbitration agreement by sending written notice of your intent to opt out to help@heyfoom.com within thirty (30) days of your initial use of the Services.
